Guideline Roofing Recommended Scope of Work

Approved Scope of Work to be provided by insurance carrier. The scope of work and materials identified below are the Scope of Work recommended by Guideline Roofing: however, Guideline Roofing is not obligated to perform any part of the scope of work that is not approved by the insurance company unless you authorize the work and agree to pay for this additional work. Guideline Roofing will provide general liability insurance coverage of $2,000,000 in aggregate.

Tear off composition shingles
Install decking (7/16” OSB) as needed (Market rate $ per sheet, 2 sheets included)
Install new felt
Valley(s) will be closed with ice and water shield
Install additional ice and water shield to code
Install shingles with starter and color-coordinated hip and ridge
Install new pipe jacks
Install ridge vent
Make a magnetic sweep of driveway and yard for removal of any nails
Remove all debris resulting from above work

Guideline Roofing will, however, perform the scope of work approved by the insurance company for the amount of the insurance approved proceeds, with no additional costs to you, except those for OSB and your deductible. The final scope and price agreed on between the insurance company and Guideline Roofing shall become the final contract price for the insurance approved scope. You will be responsible to pay for any upgrade or additional work authorized by you that the insurance company determines is not covered within the scope of coverage provided by your insurance policy. Supplemental claims billed by Guideline Roofing that are approved by the insurance company for additional work or increase in cost become a part of the contract.

Approximate Costs*

The estimated approximate costs of the services based on damages known at the time this contract. Enter the total from the approved initial insurance estimate (RCV or ACV total, whichever is greater)

Approximate Date(s) of Service*

Installation is typically scheduled 2 weeks out from contract. Enter a date range for the Monday – Friday in 2 weeks from the date of signing. Best effort will be made to finalize the installation date in this range. These date(s) of service are subject to change due to unusual delays in transportation of materials, ordinary weather delays, or by any other cause beyond the reasonable control of contractor. Dates may also be pushed based on when initial payments are received.

NOTICE: If the property owner plans to use the proceeds of a Property & Casualty insurance policy issued pursuant to part 1 of Article 4 of Title 10 C.R.S. to pay for the roof work, pursuant to Section 6-22-105, the roofing contractor cannot pay, waive, rebate, or promise to pay, waive, or rebate all or parts of any insurance deductible applicable to the insurance claim for payment for work on the covered residential property.

I/We hereby authorize & instruct the insurance company & all lien holders to include the name of Guideline Roofing as co-payee on any subsequent loss drafts or checks after today’s date as indicated at time of signing.
I/We also authorize any legal representative and/or agent of Guideline Roofing to obtain information necessary to complete work and funding process relative to the claim number referenced above.
I/We further authorize Guideline Roofing to pick up in person any loss drafts or checks or to make ACH bank account drafts as necessary on my/our behalf and behalf of Guideline Roofing.
I/We agree and authorize Guideline Roofing & Construction to make ACH bank account drafts for supplements and/or final payment using the routing and account numbers on my checks when additional installment(s) have been received from insurance.

Write separate checks for the deductible and for the initial deposit amount calculated above, and record the check numbers, Guideline Roofing will coordinate with you for receiving the checks. If you are waiting for your mortgage company to countersign the first draft payment from your insurance company, we will coordinate with you to pick up the checks after you have deposited the draft payment and it has cleared.

When you have received the initial escrow disbursement, you will write separate checks for the deductible and for the initial escrow amount and Guideline Roofing will coordinate with you to receive the checks.

Notice of Conditions

THIS CONTRACT BETWEEN GUIDELINE ROOFING (THE “COMPANY”) AND THE CUSTOMER(S) (THE “CUSTOMER”) IS SUBJECT TO ALL APPROPRIATE LAWS, REGULATIONS, ORDINANCES AND THE FOLLOWING SPECIAL TERMS AND CONDITIONS.

This contract is subject to the approval of the company’s Management & Credit Departments without exception.
ALL CHECKS FOR PAYMENT MUST BE MADE PAYABLE TO GUIDELINE ROOFING, THERE WILL BE NO EXCEPTIONS, HOMEOWNER WILL BE LIABLE TO GUIDELINE ROOFING FOR PAYMENT OF THIS CONTRACT, IF CHECK IS MADE OUT TO ANY OTHER ENTITY OR PERSON.
Out-of-pocket payments due or becoming due under this contract are to be paid within TEN (10) business days after the work has been completed. Insurance drafts are to be paid within TEN (10) business days of receipt from insurance carrier. Payments may be ACH drafted from property owner bank account after TEN (10) business days.
If any provision of this agreement should be held invalid or unenforceable, the validity and enforceability of the remaining provisions of this agreement shall not be affected.
The Company agrees to the equity in this property serving as security for the contract.
The Company shall not be liable for the failure of performance due to labor controversies, strikes, fire, weather, inability to obtain material from usual sources, Acts of God, or any other circumstances beyond the control of the Company.
If the Customer defaults on payment of this contract, or fails to pay within 10 days of receipt of payment from insurance, past due payments shall be subject to a monthly interest rate of One and a Half Percent (1.5%). Charges shall be added from the date of the default at a rate of one and one half percent per month (18% per annum) with a minimum charge of $2.00 per month. If placed in the hands of an attorney for collection, the Company shall be entitled to collect all attorney’s fees, legal filing fees, and costs expended in enforcing the collection of any charges payable under the contract.
You may cancel the contract and obtain a full refund of any deposit within seventy-two hours after entering the contract.
If this contract is canceled by the Customer later than seventy-two hours from receipt of the written notice, for a reason other than receipt of the written notice identified, the Customer shall pay the Company twenty percent (20%) of the contract price as liquidated damages, not as a penalty, and the Company agrees to accept this amount as a reasonable and just compensation for cancellation and the efforts that the Company expended in relation to the subject of this contract.
If material has to be reordered or restocked because of cancellation by the Customer, the Company will charge a restocking fee equal to fifteen percent (15%) of the contract.
The Contract does not include the replacement of deteriorated decking, roof jacks, ventilators, flashing, or other materials unless included in the contract in writing, and will then be charged on a time and material basis.
The Company’s Limited Workmanship Warranty (2 years) covers the labor to correct problems with the installation of the roof. The warranty does not cover damage to the roof caused by lightning, gale (50 MPH), hurricane, tornado, or hailstorm impact of foreign objects or damage to the roof due to the settlement, distortion, failure, or cracking of the roof deck, walls, or the foundation of the building.
The Company is not responsible for any damage below the roof due to leaks caused by excessive wind, ice, or hail during the period of the warranty. The Company’s Warranty covers the roof only.
The Company is not liable for any structural movement of the foundation or walls, settling, cracks in the dry-wall, cracking or breaking of the driveway during the roofing or loading processes, wear and tear on the grass/lawn, or minor scratching or denting of the rain gutters.
All pictures, wall hangings, lights, and collectibles, both indoors and out MUST be secured by property owner. Any damage to personal items during installation will not be the responsibility of the Company. The Company will also not be responsible for nail damage to people, animals, tires, pets, or property. Pets should not be left unattended during installation.
Any alteration or deviation from scope of work involving extra cost will be executed only upon written orders, and will become an extra charge over and above the estimate.
The Customer agrees to be solely responsible for carrying fire, tornado, and other necessary insurance.
This Contract and Labor warranty shall not be assigned and are nontransferable unless specified in writing.
The Customer will not receive material or manufacturer warranty if the contract is not paid in full.
Any discounts, signing allowance, referral fees, etc., will be revoked if account is past due.
This Contract constitutes the entire understanding of the parties and no other understanding, collateral or otherwise, shall be binding unless in writing signed by both parties. This agreement shall be considered the entire agreement by the parties. Any representation, statements, or other communications not written in this contract are agreed to be immaterial and not relied in by either party, and do not survive the execution of this contract.
The Company has the right to order excess material. All excess materials belong to the Company.
The Company reserves the right to require Customer to file for supplement insurance claims if insurance adjuster measurements are used and prove to be incorrect, the Company discovers unknown conditions, or due to an increase in cost.
The Customer has the sole responsibility to provide safe-keeping areas for all pets. The Company shall not be responsible for gates left open during or after the Company’s work.
Supplements paid by the insurance company for additional labor and/or materials needed beyond the original scope of repairs are part of this contract as if contained herein and will be paid to Company whether by the property owner or the property owner’s insurance company.
The final full payment shall not be delayed while waiting for city, county, or other building inspection department to inspect work.
Property owner acknowledges Company is a General Contractor and as such will be entitled to 10% profit and 10% overhead if approved by insurance company as part of the claim, as well as all proceeds from insurance after subtracting material costs, payments to subcontractors (whether made by the Company or by the property owner), and amounts extended for purchase of replacement of damaged items of property.
Property owner is solely responsible for Homeowner’s Association (Covenant Approval) of roofing products and color.
The Company is not responsible for damage to stucco, siding, and/or wall abuttment due to re-flashing, as a result of installing new flashing.
The Company is not responsible for satellite dish realignment.
The waiver of a breach of this contract shall not operate as a waiver of any subsequent breach by any party.
